There can be legal requirements in different contexts, such as adult content, data protection issues, copyright protected content etc. I often draft disclaimers and legal wording for websites, so contact me offlist for any specific questions. You needn't even become my client to discuss a few basis issues...

There can be legal requirements in different contexts, such as adult content, data protection issues, copyright protected content etc. I often draft disclaimers and legal wording for websites, so contact me offlist for any specific questions. You needn't even become my client to discuss a few basis issues...
Christa
Thank you all for your feedback. I've received some good suggestions that mention including Swiss penal law StGB Art. 143bis in the banner.
Cheers, Michael

Please help us to protect from citations of law texts tattered all over the walls. The law applies *even* if you don't stick your favourite snippets everywhere. When I returned from the USA to europe I was so glad to no langer have to read on *toilets* that the law forbids to leave the room whithout washing the hands...

If you choose to publish StGB 143bis as a motd, please don't forget to place stickers on all your doors and windows telling that it is forbiden to break in a house, on your car telling that vadalism and theft are illegal and on all street signs that is not allowed to ignore them.

For starters, they're barely readable when they're in all-caps :-)
My personal favourite is:
By sending email to me or to a mailing list to which I subscribe, and appending more than 4 lines of legalese at the end, you are expressly permitting me to use your email and others coming from your domain as I see fit; by posting you are accepting that your long legally sounding signature is invalid.

Oh hell. Those are probably the same idiots that make it a big fuss about when you don't deliberately break the internet by blocking all ICMP messages on your Firewalls. Or where the disclosure of the correct time is considered a security risk.
Why the hell do such organisations apply US idiocy to the sane world.

Or mapped to the current issue:
"Security cannot be declared, one can only try hard and constantly to implement it."
This is what many, many people don't understand. Especially those whit lack of technical knowledge, which then poorly have to fall back to say "but its illegal".
For example see the award winning statemant of the DECT Forum after it was discovered that most DECT phones can easly be wiretapped:
"Das DECT Forum, der internationale Verband der Home-Communication-Industrie, hält das Abhörisiko aufgrund der entdeckten Schwachstellen in der Kommunikation von Mobilteilen mit der Basisstation für gering. Das leitet das DECT Forum daraus ab, dass das Abhören von Telefongesprächen eine Straftat darstelle und es nicht möglich sei, Telefongespräche zufällig abzuhören."
http://www.heise.de/security/DECT-Forum-Abhoerrisiko-bei-schnurlosen-Telefon...
I don't think that this statement makes anybody feel safer.
Poore one if this statement is ones only answer.
Greets,
Michi
Or other wisely said: "Security is not absolute. It's just a matter of will and perseverance to break in."
Now to come back to the login banner: what exactly do you want to protect with a "lawful banner" your network/application or the operators ?
I mean, if you offer someone a login and you cannot: - ensure you can clearly identify the person loggin in - ensure that, within the reasonable limit, your authentication system is secure (2 factor authenthication, ...) why bother about statements like "I told you not to" ?
Either you set up your systems in a way you can sleep at night or you will have to deal with a potential security issue. No matter how your banner will look like.
You can actually resume the whole story in two simple words: risk management.

Huh...that topic has gone far ... :)
Anyway, IBM had years ago a legal case in the US against a hacker: the system said "Welcome to AIX" .... And he forced that welcome...
