Thanks for the answers. I've tried to call KOBIK, but they have a) no direct phone number and b) give no answers on the phone. Not very motivating of an ISP who wants to make a good job.
However, i've entered the form at http://www.cybercrime.admin.ch/content/kobik/de/home/meldeformular.html and now we wait and see.
If i'm allowed to publicly post the answer from them, i'll do so when it arrives.

There is a very recent invention for this type of question. It's called a lawyer. Some of them even have web sites and can be reached by email.
Even more interesting I remember some of them specializing in Internet related things and giving presentations at SWINOG meetings some time back.
The bad news is they want some money for their expertise and knowledge. It's not for free like Firefox, Linux or MySQL. Or web-hosting and DSL access... Maybe I mixed something up here...
To give you a hint on the answer to your question: Many moons ago the Spielbankenkomission sent a letter to many ISP demanding (not just requesting) to block access to *all* money gambling and betting sites on the Internet. Non-compliance of blocking was said to be as bad as running such an illegal site yourself. You know, many years in government sponsored wellness club with heavily filtrated air...

I understand your reasons. I was being snarky/funny because you've tried to outsource a elementary business function (your own judgement) to this list without first doing a minimal effort at researching the issue yourself.
Before you waste 5 minutes of (N * subscribers) of this list time you should spend at least 5 minutes of your own time googling the issue first. Yes, you may have to try different search phrases and you may have to click the next button to get to the second page to find something relevant for your case.
Only if the answer isn't there after trying for a bit, or you're still horribly confused because of conflicting information asking the list is appropriate.
I took objection to your original mail because of "potential customer is asking whether bla is legal". You're the one winning the customer when the answer is yes. So we can expect you to at least do some classic pre-sale homework yourself at your own cost first. Or have your secretary do it. Or your lawyer.
