Now it hasn't wather... At 11:00 Uhr the wather was 20 cm high... I think Lucerne has more wather than Zurich now... In the Evening it has lot of ice on the street... Hello all, First of all, I'm not to well known on this list although I'm reading it for some time now. For this I probably shouldn't be ranting arround here. But one thing I keep *wondering* and annoying about is the fact that the swiss networking elite seems not to be able to configure their mailers and mail facilities to correctly and politely interfer with a mailinglist. OK, its requires skills and of course some technical magic to configure something as complex as a mailclient correctly. But for all those who are unwilling or unable to fullfill this job on their own there *is* in fact a solution to this problem. It is (astoundingly enough) possible to use more than one email account for exchangeing electronic mail. So I dare to kindly ask those unable to go without something evil like an *autoresponder* to switch their mailinglist subscriptions to another address where they do not need to inform the senders about their holidays? at last: http://www.vpb.admin.ch/deutsch/doc/69/69.106.html very short summary of more than 20 pages of legal talk: spamming infringes swiss data protection law. or in german, copied from the decision: (DSG: Datenschutzgesetz) - Die Zustellung von unverlangter E-Mail-Werbung an unbekannte und wahllos zusammengestellte Adressen, welche im Internet gesammelt wurden, stellt eine widerrechtliche Datenbearbeitung im Sinne von Art. 12 Abs. 2 Bst. a in Verbindung mit Art. 4 DSG dar (E. 5.1-5.7). - Aus der Wirtschaftsfreiheit fliesst kein Rechtfertigungsgrund gemäss Art. 13 Abs. 1 DSG; insbesondere liegt kein überwiegendes privates Interesse der bearbeitenden Person vor (E. 5.8). - Einzig die ausdrückliche vorherige Einwilligung der Betroffenen wäre geeignet, bei Massenversand von E-Mail-Werbung eine widerrechtliche Persönlichkeitsverletzung im Sinne des DSG auszuschliessen (E. 5.9). - Eine «Opt-Out»-Möglichkeit in unangeforderten Werbe-E-Mails hebt demnach die Rechtswidrigkeit ihres Versandes nicht auf.
